Notice of Motion / Ruling on Application to Set Aside Default Judgment and for Joinder/substitution of Parties

  1. 1 Whether the court should set aside the default judgment entered on 2nd November 2017.
  2. 2 Whether the defendants were properly sued by the plaintiff/decree holder.
  3. 3 Whether the applicants are entitled to the orders sought for joinder and substitution.

Ratio Decidendi

The court found that the applicants failed to provide sufficient reasons for their failure to enter appearance or file a defence within the prescribed period, and brought the application after an inordinate and inexcusable delay of over six years since judgment. The applicants also failed to annex a draft defence, preventing the court from assessing whether there were triable issues. The court held that the default judgment was regular, the issue of misjoinder or non-joinder of parties was overtaken by events and functus officio, and the application lacked merit. Consequently, the court dismissed the application with costs to the plaintiff/decree holder.
