Ratio Decidendi

The appellate court found that the respondent suffered multiple soft tissue injuries which were in the process of healing and were not expected to result in permanent disability. Upon comparing the injuries and awards in the authorities cited by both parties, the court concluded that the trial court's award of Kshs. 300,000/= was on the higher side. The court held that an award of Kshs. 180,000/= was adequate compensation for the injuries suffered. The trial court's award was therefore set aside and substituted with Kshs. 180,000/=. Special damages and the agreed contribution ratio of 30% were left undisturbed. The costs of the appeal were awarded to the appellant.
