The Court held that an advocate on record is the general agent of the client in all matters arising in the course of proceedings, including the receipt of settlement monies. There is no legal requirement for insurers or tortfeasors to pay damages directly to the injured party while paying costs separately to the advocate. Section 136 of the Transfer of Property Act 1882 does not prohibit advocates from receiving monies on behalf of clients; it only prohibits trafficking in actionable claims by certain persons. The Civil Procedure Rules and the Advocates Act provide adequate safeguards for clients, and the insurer is protected by a duly executed discharge voucher. The appeal was therefore...
