Procedural Posture

Contempt Application / Ruling on Notice of Motion for Committal to Civil Jail for Contempt

  1. 1 Whether the application dated 12th October, 2017 is time barred under Section 34 of the Contempt of Court Act.
  2. 2 Whether the 1st and 2nd Respondents are in contempt of the court orders granted on 14th October, 2016.

Ratio Decidendi

The court found that although the 1st and 2nd Defendants were present in court and aware of the order to deposit the title deed, the application for contempt was filed more than six months after the alleged contempt, contrary to Section 34 of the Contempt of Court Act. The court held that the application was time barred and therefore could not be allowed. However, in the interest of justice, the court ordered the 1st and 2nd Defendants to deposit the title deed within 21 days, failing which they could be cited for contempt. The court emphasized that the absence of a stay of execution and the Respondents' knowledge of the order did not cure the statutory time bar for contempt proceedings.

Court Disposition

Application dismissed as time barred under Section 34 of the Contempt of Court Act. 1st and 2nd Defendants ordered to deposit title deed within 21 days.

Orders

  • The application dated 12th October, 2017 is dismissed as time barred.
  • The 1st and 2nd Defendants are ordered to deposit in court the title deed to the suit land within 21 days from the date hereof, failing which they can be cited for contempt.
