The Plaintiffs failed to prove that the surrender of land to the Defendant upon sub-division was excessive or illegal. The evidence established that while the minimum required surrender was 20%, the Plaintiffs voluntarily surrendered 43% of their land, and there was nothing unlawful about this as the law does not set a maximum limit. The Plaintiffs did not challenge the surrender until 25 years after the approval, and the Town Planning Committee did not approve any recovery of the surrendered land.
