The court found that the applicant failed to discharge the burden of proof required to establish that there was an agreement to waive the taxed costs following his reinstatement to employment. The documents annexed by the applicant did not evidence any such waiver, and the applicant did not take steps to compel production of the relevant minutes from the respondents, who were the custodians. The court held that the applicant misled the court in obtaining interim orders and that there was no legal or factual basis to grant a stay of execution of costs or to declare the costs settled. The application was therefore dismissed with costs to the respondents and interested parties.
