The court found that the Respondent failed to provide evidence of any performance issues communicated to the Claimant or to follow the mandatory procedures for termination on grounds of poor performance or redundancy. The Respondent did not comply with Section 41 or Section 40 of the Employment Act, which require notification, hearing, and specific redundancy procedures. The absence of due process rendered the termination both substantively and procedurally unfair. The Claimant was therefore entitled to compensation for unfair termination and severance pay, but not to unproven claims for salary and leave pay balance.
