Ratio Decidendi

The court found that the appellant's plea of guilty was unequivocal, as the charge was read in a language he understood and he admitted both the charge and the facts. The trial court followed the correct procedure as set out in Adan v Republic. On sentence, although the maximum penalty for stealing by servant is 7 years, the appellant was a first offender, pleaded guilty, and about half of the stolen property was recovered. The court held that these mitigating factors warranted a reduction of the sentence from 3 years to 2 years imprisonment. The conviction was upheld, but the sentence was set aside and substituted with a 2-year term.
