However, the Respondent admitted the employment relationship and salary, and did not rebut the Claimant's evidence that he was not paid certain terminal benefits upon separation. The court therefore awarded the Claimant Kshs 34,000 for leave in lieu and arrears salary, but dismissed claims for notice pay, general and punitive damages, and the counterclaim for lack of evidence.
