Ratio Decidendi

The trial court erred in law by failing to consider the two months the applicant spent in pre-trial custody when imposing sentence. Section 333(2) of the Criminal Procedure Code requires that such period be taken into account. The High Court, exercising its revisionary jurisdiction, found this omission to be a material error warranting interference with the sentence. Accordingly, the applicant's custodial sentence was revised to deduct the two months spent in pre-trial custody, with the revised sentence to run from the date of conviction.
