Ratio Decidendi

The court found that the Advocate/Applicant was entitled to interest at the rate of 14% per annum on the taxed costs, as provided by Paragraph 7 of the Advocates Remuneration Order. The court determined that the Bill of Costs was served on the Client/Respondent on 15th June 2023, as admitted by the Respondent in their own pleadings, despite the absence of an affidavit of service. Interest was therefore to accrue from 30 days after service, i.e., from 15th July 2023, until full settlement of the certificate of costs. The court further held that it had no discretion to vary the statutory rate of interest, and the Advocate/Applicant was also entitled to the costs of the application.
