The court found that Likoni Developers Ltd acted as an intermediary or agent for a disclosed principal, Wanani Exports and Imports Co. Ltd, and was not a principal to the contract for the supply of cottonseed. The contract dated 2nd February 1991, if it was a contract at all, was immediately superseded by the contract dated 4th February 1991, which was directly between the plaintiff and Wanani. Furthermore, the failure to supply cottonseed was due to a supervening illegality, namely the Tanzanian government's ban on the export of cottonseed, which rendered performance impossible.
