The High Court found that the trial court erred in applying a dependency ratio of 1/3 instead of 2/3, given the deceased was married with a child, and in using a multiplier of 30 years instead of 20 years, failing to consider the vicissitudes of life and the lump sum nature of the award. The court recalculated the loss of dependency using a net income of Kshs. 24,000, a multiplier of 20 years, and a dependency ratio of 2/3, resulting in an award of Kshs. 3,840,000. The court also found that the trial court failed to award funeral expenses of Kshs. 40,000, which were specifically pleaded and proved, and substituted the special damages award to Kshs. 50,150.
