The court held that it was not functus officio in respect of objection proceedings and post-judgment applications incidental to execution, as provided under Order 22 Rule 51 of the Civil Procedure Rules. The objector established legal and equitable interest in Motor Vehicle KBY 743 N, as the plaintiff had acknowledged full payment and prior court orders exempted the vehicle from attachment. The repossession of the vehicle by the plaintiff was therefore illegal and in contempt of court orders. The court found that the plaintiff and its directors were in contempt for instructing repossession despite being served with stay orders, and accordingly lifted the corporate veil to hold the...
