Ratio Decidendi

The court found that while there were valid reasons for the Claimant's dismissal due to misappropriation of funds, the Respondent failed to accord the Claimant a fair hearing as mandated by section 41 of the Employment Act. The procedure followed did not allow the Claimant to adequately present his case or challenge the evidence against him. The subsequent appeal process did not cure the procedural unfairness of the original dismissal. As a result, the summary dismissal was procedurally unfair, entitling the Claimant only to pay in lieu of notice, but not to general or exemplary damages, special damages, or interest, as these were either not grounded in law or not supported by evidence.
