Ratio Decidendi

The court found that the applications for transfer did not allege that the suits were instituted in breach of the law regarding the place of suing. The respondents' concession to transfer was accepted as being motivated by the need for convenience and not as an admission of improper forum. The grounds upon which the applications were predicated, such as the Section 34 issue, were not compromised or determined by the consent and remain for determination by the trial courts. The court exercised its discretion and held that each party should bear its own costs, as there was no basis to censure the respondents or to find that the applicants had succeeded in a manner warranting an award of costs.
