The court found that the applicant was not accorded fair administrative action as required by Article 47 of the Constitution of Kenya. The respondents failed to prove that the meeting allegedly held to remove the applicant as chairman was authentic, as the list of attendees was found to be fabricated and unreliable. The KUPPET Constitution's procedures for removal of a branch executive were not followed, and there was no evidence that the applicant was given notice of the allegations against him or an opportunity to be heard. The court held that any action purporting to oust the applicant was null and void for want of due process and violation of constitutional rights to fair labour...
