The Principal's delegated authority to discipline or dismiss staff did not make him the employer responsible for payment of terminal dues or compensation. The court held that the proper party to sue for employment-related claims is the employer, in this case the Board of Management, and not the Principal in his personal capacity. As such, the suit was untenable and could not result in the reliefs sought by the Claimant. The court therefore dismissed the suit against the Respondent with costs, capped at Kshs. 30,000, for legal representation.
