Once a party has testified and closed their case, the opposing party cannot be permitted to introduce new evidence, as this would deny the first party an opportunity to rebut and could allow the applicant to tailor their case in response. The Respondent failed to provide a satisfactory explanation for not filing the documents earlier, and the court found that allowing the application would be prejudicial to the Claimant and contrary to the principles of fair trial and procedural fairness.
