Ratio Decidendi

The High Court found that the sentence of three years imprisonment imposed on the appellant for stealing stock was neither harsh nor excessive. The trial magistrate had considered the possibility of a non-custodial sentence but was dissuaded by the negative pre-sentence report and the appellant's poor standing with his family and community. Given that the maximum sentence under Section 278 of the Penal Code is fourteen years, the three-year sentence was within the statutory limits and justified by the circumstances. The appellate court therefore declined to interfere with the sentence and dismissed the appeal.
