Ratio Decidendi

The court found that the claimant failed to prove, to the required standard, that the respondent unfairly or wrongfully dismissed him. Conversely, the respondent, while having a valid reason to terminate the claimant's employment, did not demonstrate that it followed the law in effecting the termination. The court thus treated the separation as if it were by mutual agreement under normal circumstances, entitling the claimant to one month's salary in lieu of notice and service pay at the rate of fifteen days' salary for each complete year of service. No order was made as to costs.
