The court held that a suit filed in a court without jurisdiction is incompetent and void in law, and therefore cannot be transferred to another court. The High Court's power to transfer suits under Section 18 of the Civil Procedure Act is limited to suits that were properly instituted in a court with jurisdiction. Since the subordinate court lacked pecuniary jurisdiction over the subject matter, the suit was a nullity ab initio. The court further held that the professional error in filing the suit in the wrong court is fundamental and cannot be excused as an ordinary mistake.
