Procedural Posture
Civil Case / Ruling on Application to Set Aside Dismissal for Want of Prosecution
Legal Issues
- 1 Whether the suit should be reinstated after dismissal for want of prosecution.
- 2 Whether the court should exercise its discretion to set aside the dismissal order.
Ratio Decidendi
The court found that the application to set aside the dismissal of the suit for want of prosecution was unopposed and that it was appropriate to exercise its discretion in favour of reinstating the suit. The court emphasized the importance of determining cases on their merits and not shutting out parties from the seat of justice due to procedural lapses, especially where there is no opposition to the application. Accordingly, the order dismissing the suit was set aside and the suit reinstated for hearing.
Court Disposition
Application allowed; suit reinstated.
Orders
- The order of 18th September 2023 dismissing the suit for want of prosecution is set aside.
- The suit is reinstated for hearing on merit.
