Ratio Decidendi

The Court found that the applicant had satisfied both limbs required for the grant of stay of execution pending appeal: the intended appeal was arguable, particularly on whether an employee can be reinstated after more than three years out of employment, and that if stay was not granted, the appeal would be rendered nugatory as reinstatement would make the appeal superfluous. The Court exercised its discretion under Rule 5(2)(b) of the Court of Appeal Rules, holding that the interests of justice warranted the grant of stay. The application for stay of execution was therefore allowed, with costs to abide the outcome of the intended appeal.
