Both notices of appeal subsist on record, and the existence of multiple notices does not vitiate the application for stay. The proper procedure to remove a notice of appeal is to apply to strike it out, not to withdraw by letter. Therefore, the preliminary objection was dismissed as there was a valid notice of appeal on record to support the application for stay.
