Ratio Decidendi

The Court held that there is no rule prohibiting the filing of more than one notice of appeal in respect of a single decision, and the existence of multiple notices does not mean that a notice of appeal has not been lodged. Furthermore, there is no provision in the rules for withdrawal of a notice of appeal by letter; such a notice remains on record until struck out or otherwise dealt with under the rules. Therefore, the preliminary objection to the Notice of Motion for stay was dismissed, as there was at least one valid notice of appeal on record upon which the application could be predicated.
