Ratio Decidendi

The Court of Appeal held that the trial court erred in awarding general damages of Ksh. 3 million in addition to the statutory maximum compensation of 12 months’ salary for unfair termination under section 49(1)(c) of the Employment Act. The appellate court found that general damages are not awardable for wrongful dismissal, and compensation must be limited to statutory entitlements. The respondent was only entitled to salary arrears for the period of interdiction up to the date of dismissal (21st June 2006), not beyond. The court also held that the trial court became functus officio after its initial judgment and could not issue further substantive monetary orders. The appeal was allowed...
