Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the Grievant was employed on a term contract.
  2. 2 Whether the Grievant was declared redundant by the Respondent.
  3. 3 Whether the Grievant is entitled to the reliefs sought for notice pay and accrued leave.

Ratio Decidendi

The court found that the Respondent failed to provide sufficient evidence that the Grievant's contract ended solely due to project completion, as no documentation of project completion was produced. The Grievant's employment was terminated at the Respondent's initiative, and the Respondent did not comply with the redundancy procedures under section 40 of the Employment Act. The Grievant was entitled to one month's notice pay and accrued leave, but not to service pay, as he had worked for only 11 months. The court awarded the Grievant Kshs. 24,000 as notice and Kshs. 8,800 as pro rata leave, plus costs and interest.
