Ratio Decidendi

The court found that, according to Section 79G of the Civil Procedure Act, an appeal must be filed within thirty days from the date of the decree or order appealed against. However, Order 50 Rule 4 of the Civil Procedure Rules provides that the period between 21st December and 13th January is to be omitted from the computation of time. Taking this into account, the appellant was required to file the appeal by 26th January 2016. The Memorandum of Appeal was filed on 25th January 2016, which was within the prescribed time limit. Therefore, the application to strike out the appeal for being filed out of time was without merit.
