Ratio Decidendi

The court found that the appellant, as garnishee, failed to dispute its liability at the appropriate stage in the lower court proceedings, despite being duly served. The garnishee order was made absolute after due process, and the appellant paid the decretal sum to the decree-holder. Since no issue of indebtedness or refund was raised in the lower court, the appellant cannot raise such grounds for the first time on appeal. Any cause of action the appellant may have against the judgment-debtor must be pursued in a fresh suit, not by way of appeal in the garnishee proceedings. Consequently, the appeal is without merit and is struck out with costs to the decree-holder.
