The Tribunal found that its jurisdiction is strictly conferred by the Constitution and the Political Parties Act. Section 40(1)(fa) of the Act only allows the Tribunal to hear disputes between a member of a political party and the party, and the applicant was not a member of the relevant party. Furthermore, Section 40(2) requires that such disputes first be subjected to the party's internal dispute resolution mechanism, which was not done in this case. The Tribunal also held that once the nomination process is complete and the candidate's name has been forwarded to the Independent Electoral and Boundaries Commission, its jurisdiction ceases.
