The petition failed to set out with reasonable precision the particulars of the alleged constitutional violations, relied on blanket and unsupported allegations, and did not specify any reliefs sought as required by Rule 10(2) of the Mutunga Rules. The court held that the defects were incurable and irredeemable, rendering the petition frivolous and vexatious. As such, the petition was struck out in its entirety, with each party to bear its own costs.
