The court found that although the Respondent was not obligated to renew the grievant’s fixed-term contract after its expiry, the continued retention and payment of the grievant for over three months after the contract’s lapse created an employment relationship requiring notice for termination under Section 35(1)(c) of the Employment Act. The CBA, which was still in force, entitled the grievant to three months’ notice or pay in lieu thereof. The Respondent only paid one month’s notice, thus failing to comply with the CBA and rendering the termination procedurally unfair.
