Ratio Decidendi

The Court held that the application dated 6th September 2016 was irregular and amounted to a multiplicity of applications seeking the same relief, which is not permissible. The proper procedure would have been for the applicant to seek an expedited hearing of the earlier application dated 1st August 2016. The Court therefore struck out the later application and directed the Deputy Registrar to reschedule the hearing of the earlier application within 14 days. Costs of the struck-out application were awarded to the respondent.
