Procedural Posture

Miscellaneous Application / Ruling on Amended Originating Summons

  1. 1 Whether the advocate is obliged to pay the client KShs.500,000.00 and KShs.130,000.00 received on the client.s behalf.
  2. 2 Whether the advocate is entitled to withhold client funds on account of alleged unpaid legal fees.
  3. 3 Whether the advocate must furnish a statement of accounts and deliver documents to the client.

Ratio Decidendi

The court found that the advocate had received KShs.500,000.00 and KShs.130,000.00 on behalf of the client and was obliged to remit these sums, less only the amount of taxed costs as determined in HC Misc. Application No.591 of 2005. The advocate's claim to set off further alleged fees was rejected as those fees had not been taxed or demanded prior to the proceedings. The advocate's failure to respond to the KShs.130,000.00 claim rendered the applicant's position uncontroverted. The court held that the advocate must pay the net sum due, furnish a statement of accounts, and deliver all relevant documents to the client. Costs were awarded to the applicant.
