The court found that the respondent failed to comply with the mandatory requirements of section 40(1) of the Employment Act in effecting the redundancy. There was no evidence of prior written notice to the union or labour officer, no justification for the selection of the grievants, and no payment of terminal dues. As such, the termination of the six grievants (excluding Mr. Patrick Muriithi, for whom no evidence of employment or termination was adduced) was both unfair and unlawful. The court awarded each grievant one month’s salary in lieu of notice, ten months’ salary as compensation for unfair termination, and service pay at the rate of 15 days’ pay per year of service.
