The court found that the Plaintiff was allocated the suit property by the Government to hold in trust for industrial development and that the 3rd Defendant was only a conditional allottee, required to obtain written consent from the Plaintiff before any transfer. The 3rd Defendant failed to comply with the conditions of allotment, including obtaining written consent and developing the property. The purported sale to the 1st and 2nd Defendants was therefore null and void. The Plaintiff was entitled to repossess the property upon breach of the allotment conditions.
