The registered proprietor remained Veronicah Akong’o Nyamodi, and the Plaintiff had not taken legal steps to challenge her registration. The 1st Defendant's statutory power of sale had arisen due to default, and no party had successfully impugned the title. The Plaintiff also failed to demonstrate irreparable harm or that the balance of convenience favoured it. Consequently, the application for injunction was dismissed.
