Grounds 3 and 4 of the objection required factual ascertainment and were therefore not proper grounds for a preliminary objection. The issue of representation had been resolved by consent between the advocates on record. On the question of functus officio, the Tribunal held that Rule 17 of the Cooperative Tribunal Rules expressly empowers it to set aside ex parte judgments, orders, or awards, and thus the Tribunal is not functus officio in respect of the application dated 19th December 2023.
