The Court found that the applicant had demonstrated an arguable appeal, particularly on the issues of natural justice and the right to be heard, given the circumstances surrounding the ex parte hearing and judgment. The Court further held that the decretal sum was substantial and that the respondent had not shown he would be able to refund the amount if the appeal succeeded, thus rendering the appeal nugatory if execution proceeded. As the applicant is a State Corporation, the Court saw no justification for requiring a deposit of the decretal sum. Accordingly, the Court allowed the application and granted a stay of execution pending the hearing and determination of the intended appeal.
