Therefore, the appeal was not out of time and the prayer to strike out the entire record of appeal failed. However, the Court held that only documents produced before the High Court may be included in the record of appeal. Documents at pages 419 to 681 of the supplementary record of appeal were not produced in the High Court, and no leave was sought to introduce them as additional evidence.
