The court found that while the respondent had a fair and justified reason to summarily dismiss the grievant for failing to secure the premises and possible collusion with intruders, the disciplinary process was procedurally unfair. The process was concluded within three days, which did not allow the grievant sufficient time to prepare a defense, violating Section 41 of the Employment Act and principles of procedural fairness. Although the dismissal was substantively fair, the lack of procedural fairness rendered the dismissal unfair in law.
