Ratio Decidendi

The court found that the Respondent failed to prove valid and fair reasons for the Grievant's summary dismissal. The evidence did not support the allegations of gross misconduct or insubordination, as the Grievant had written the required statements and was not responsible for the unauthorized entry incident. Although procedural requirements under section 41 of the Employment Act were met, the lack of substantive justification rendered the dismissal unfair under section 45(2) of the Employment Act. Consequently, the Grievant was entitled to remedies including gratuity, compensation for unfair dismissal, notice pay, leave dues, unpaid salary, and a certificate of service.
