Ratio Decidendi

The Court found that the applicant had demonstrated both limbs required under Rule 5(2)(b): the intended appeal was arguable, particularly on the lawfulness of the respondents' termination and alleged discrimination, and there was doubt as to the respondents' ability to refund the decretal sum should the appeal succeed, thus rendering the appeal nugatory if stay was not granted. The Court therefore granted a conditional stay of execution, requiring the applicant to deposit Kshs. 5,000,000 in a joint interest-bearing account within sixty days, failing which the stay would lapse.
