Miscellaneous Application / Ruling on Application for Leave to File Notice of Appeal Out of Time

  1. 1 Whether the claimant should be granted leave to file a notice of appeal out of time.
  2. 2 Whether the claimant was properly served with notice of the judgment date.
  3. 3 Whether the Employment and Labour Relations Court has jurisdiction to grant leave to file notice of appeal out of time under the Court of Appeal Rules.

Ratio Decidendi

The court found that under Rule 77 of the Court of Appeal Rules 2022, a notice of appeal must be filed within 14 days of the judgment. In this case, judgment was delivered on 28th September 2023, and the period for filing notice of appeal lapsed on 12th October 2023. The court held that it lacked jurisdiction to grant leave to file a notice of appeal out of time, as such applications should be made at the Court of Appeal. Even if the application were allowed, the claimant would still need to seek leave at the Court of Appeal. The court therefore dismissed the application as unmerited.
