The Court found that the circular issued by the Chairman Council of Governors on 15th February 2019 was illegal and an overreach, as the Chairman and the Council have no statutory authority to interfere with the deduction and remittance of trade union dues, which is governed by Legal Notice No. 160 of 2018 and the Labour Relations Act, 2007. The only competent authority to issue or reverse such orders is the Cabinet Secretary for Labour. The Court held that the deduction and remittance of union dues is an ongoing statutory obligation of the County Governments, and that the Claimant is entitled to have such deductions continue.
