The court found that the Registrar of Trade Unions' circular of 25th November 2015, which sought to dictate the timing and supervision of trade union elections, was unconstitutional and null and void to the extent that it interfered with the union's autonomy as protected by Article 41 of the Constitution and Section 34 of the Labour Relations Act. The Registrar's refusal to register the Appellant's officials on the basis of non-compliance with the circular was similarly unlawful, as the only legal requirement is that elections be conducted in accordance with the union's registered constitution and that notice of elected officials be given to the Registrar within fourteen days.
