Procedural Posture

Miscellaneous Application / Ruling on Application to Set Aside or Vary Taxation

  1. 1 Whether the applicant was entitled to file a fresh application to set aside or vary the ruling on taxation instead of filing a reference within the original taxation proceedings.
  2. 2 Whether the application to set aside or vary the taxation ruling was properly before the court.

Ratio Decidendi

The court held that the applicant's recourse, if aggrieved by the taxing officer's decision, was to file a reference by chamber summons within the original taxation proceedings (Mombasa High Court Misc Application No. E055 of 2023) as prescribed by Rule 11 of the Advocates Remuneration Order. Filing a fresh miscellaneous application was procedurally untenable. The application was therefore improperly before the court and was struck out as a nonstarter.
