The court found that the Respondent failed to comply with the procedural requirements set out in section 41 of the Employment Act, 2007, as there was no evidence that the Grievant was informed of the charges against him or given an opportunity to respond before dismissal. The audit report and post-dismissal meetings did not satisfy the statutory obligation to conduct a fair hearing. Consequently, the summary dismissal was procedurally unfair. The Grievant was therefore entitled to one month pay in lieu of notice, salary for June 2011, outstanding leave, compensation equivalent to five months' gross pay, and costs.
