The court found that the applicant's delay in seeking leave to appeal out of time was not inordinate and was satisfactorily explained, as the applicant only became aware of the ruling striking out the appeal on 20th January 2015 and filed the present application within one and a half months. The court held that the intended appeal was arguable and that the applicant had provided sufficient security by depositing the decretal sum in court. The court further determined that substantial loss would occur to the applicant if stay of execution was not granted, as realization of the amount by the respondent would undermine the applicant's right of appeal.
